What the charge concerned
The charge was laid by a Professional Conduct Committee appointed by the Dental Council of New Zealand and heard over several days between July 2021 and March 2022. According to the summary, it related to 14 patients and alleged that, between about January and December 2018, the dentist conducted himself inappropriately and unprofessionally towards patients by:
- not putting patients’ interests first, by failing to attend scheduled appointments, provide ongoing care, or provide orthodontic plates patients had paid for;
- putting patient care at risk, by failing to regularly monitor orthodontic treatment, provide dental records when requested, or respond to patient enquiries; and
- not communicating openly with patients, by failing to tell them when he was unavailable or respond to their calls and emails.
The Tribunal's findings
The summary records that the Tribunal found all three particulars of the charge established. It found the conduct was not mere negligence or inadvertence, and that it amounted to professional misconduct under section 100(1)(a) and (b) of the Health Practitioners Competence Assurance Act 2003 (NZ).
The summary also records that the dentist did not initially take part in the hearing. After he contacted the Tribunal on the second day, the hearing was adjourned to deal with procedural issues he raised, and later resumed.
Orders
The Tribunal ordered:
- censure;
- cancellation of his registration;
- a contribution of $57,500 to the Professional Conduct Committee’s costs; and
- a contribution of $41,500 to the Tribunal’s costs.
The Tribunal directed publication of the decision and a summary. The summary records that an application for permanent suppression of the dentist’s name was dismissed, and that the names and identifying details of the patients are permanently suppressed.
